TORONTO - From former US president, Donald J. Trump is now a convicted felon.

A jury of 12 New Yorkers on Thursday found the presumptive Republican presidential nominee guilty on all 34 counts of falsified business records, multiple news outlets reported.

The jury of seven men and five women reached their decision after deliberating for two days. The trial had lasted for six weeks in a Manhattan courtroom presided by Judge Juan Merchan.

Trump faces up to four years in prison. However, media reports said he's unlikely to be incarcerated as he is a first offender of a non-violent offense.

Trump's conviction was historic. It made him the first former US president to be convicted of a crime.

Prosecutors argued Trump authorized records to be falsified to conceal a crime, i.e., by paying hush money to porn star Stormy Daniels to silence her about their sexual relation because it would affect his presidential candidacy in 2016. Though the authorities and their ethnic media partners would be hard-pressed to admit their inadequacy that had resulted in wrongs being committed to their faces a year ago, a move is underway to strengthen oversight on taxpayers' money being doled out to selected news outlets that include a left-leaning Filipino tabloid recently exposed for its corrupt practices.

TORONTO - After months of inaction on a complaint by a Filipino-Canadian journalist against editors of a Filipino tabloid, the Department of Canadian Heritage appears to be strengthening control of federal money that funds its Local Journalism Initiative (LJI) and demanding more accountability from its administrator.

Absent any official acknowledgement, such heightened oversight must have been precipitated by the largely-ignored disclosure by writer Michelle Chermaine Ramos of the lies and deception foisted on her and on another writer in Edmonton, Alberta by husband-and-wife editors Hermie Garcia and Mila Garcia of the left-leaning The Philippine Reporter (TPR).


Since her exposé was published in a series of articles in this online magazine last year, the parties that seemed to have had unwittingly enabled the Garcia couple, namely, the Department of Canadian Heritage, the National Ethnic Press and Media Council of Canada (NEPMCC) and their top officials, had practically shrugged off the fully-documented revelations.

Until now.

In a move that nearly escaped notice, Canadian Heritage demanded, and NEPMCC accepted and granted, the appointment of a "coordinator" to liaise with each other concerning the government-funded LJI where TPR is a participant under the direction of NEPMCC.

The LJI provides financial support to NEPMCC which then vets qualified members so they could expand news coverage in underserved communities.

"Miniter (sic) of Heritage demanded a coordinator to be liaison between the federally run LJI and Student Internship programs and NEPMCC," according to the minutes of the NEPMCC meeting on April 8, 2024 which was published on its website only last week.

During the online monthly meeting, a motion to effect the demand was "unanimously carried" by members who then named NEPMCC executive and managing director Maria Voutsinas as coordinator, according to the minutes,

Canadian Heritage's request appears to be a major change of its attitude towards NEPMCC. In mid-January, NEPMCC president Thomas Saras explained that the "LJI program was on hold due to the delay by the ministry of Canadian Heritage".

Mr. Saras' statement could be a euphemism for the scrutiny the federal agency was presumably conducting on LJI as an offshoot of the Garcias' attempt to stiff two writers that Ms. Ramos had uncovered while seeking redress for delays in salary.

The impact of the agency's heightened oversight has not been fully explained by officials of both Canadian Heritage and NEPMCC, the  LJI implementor. 

They also did not respond to repeated requests for comments soon after Ms. Ramos divulged last year how TPR and the Garcia couple made a mockery of LJI with their lies and deception about the LJI grant money.

Before that, Ms. Ramos, a staffmember; and an intern, a member of the youth group Anakbayan in Edmonton, Alberta, reported for TPR, filled news quotas required by LJI, and were to be compensated by TPR from funds provided by Canadian Heritage through NEPMCC.

Both writers worked diligently until Ms. Ramos, who has written 39 articles for LJI and published in TPR from April 2022 to November 2022, noticed persistent delays in her pay. (Related video: https://www.youtube.com/watch?v=g8FT2kEZfls)

Hermie Garcia laid the blame for the slow payments on Canadian Heritage and on NEPMCC. 


He specifically pinpointed to a person supposedly managing the grant whom he called the "guy in charge of disbursements" as responsible for withholding the funds. The grant as he explained to Ms. Ramos come in "trickles of small amounts and most of the time delayed for months".

Finally fed up, she inquired from Ms. Voutsinas why her LJI salary was being held up for months. That's when everything came to light. (Full story: Lies, Deceptions by The Philippine Reporter Exposed)

Not only was Hermie Garcia lying to Ms. Ramos, he even created a "grant guy" - a phantom - to conceal his wrongdoing. It also turned out from that inquiry that the Edmonton-based intern was not being paid for many months.

Ms. Voutsinas, according to Ms. Ramos, told her there was no reason for her LJI pay to be delayed because the NEPMCC had already released the LJI grant money for one full year to Hermie Garcia in one lump sum.

Moreover, contrary to what Hermie Garcia was claiming, there was no "grant guy" to begin with, as it was her (Ms. Voutsinas) who handled the money on NEPMCC's behalf.

Despite the lies and deception by the Garcia couple, the NEPMCC has remained silent on the issues and complaints raised by Ms. Ramos.

It seems, however, that NEPMCC and the Department are working quietly to reform how LJI money is disbursed to members. Meanwhile, one big question persists: Were the Garcias disciplined, chastised, or anything? (Copyright 2024. All Rights Reserved).

For more than once in her legal disputes, the publisher of Balita has shown a potential for theatre with a particular audience in mind: the fogies who rely on the tabloid for information instead of the internet. As she doesn't seem to fact-check wild allegations of wrongdoing that see print, the result could be catastrophic, especially financially. Still, her bravado, or false bravado, remains intact in her published declarations.

TORONTO - Sixteen months ago, Teresita "Tess" Cusipag of Balita declared she would hire "not just lawyers" but "good ones instead."

"I learned my lessons, being thrifty and underestimating," she said then, an intimation of the legal and financial debacle resulting from losses she suffered fighting two of four defamation lawsuits years past.

In one of them, the judge cited her for criminal contempt and sentenced to 21 days of incarceration in a women's facility. She was released after serving 13 days. (Related video: 'A Humbling Experience,' Says Balita Editor Tess Cusipag of Ordeal).



Now it would appear that she didn't keep her word. The "not-just-lawyers-but-good-ones" statement fell flat on her face as she lost the latest - the fifth in the list - defamation case filed against her, this time, by businesswoman Liwayway Miranda aka Lily Hammer.

Weeks before I wrote that bombshell story, I noticed a sudden uptick in the number of readers keeping track of a dozen articles about Balita and its publisher/editor posted on Filipino Web Magazine.

I thought the word has probably gotten out, though unpublished in any of the local periodicals, that Ms. Miranda has been successful in holding Ms. Cusipag liable for her libelous comments in Balita and on Facebook.

At the funeral of a common friend a month ago today, Ms. Cusipag surprisingly greeted me with a "Hi Romy". Since my departure from Balita in July 2019, I avoided her whenever I can despite well-meaning attempts by my favorite entertainment writer Baby K. Jimenez to restore the friendship.

Anyway as a courtesy, I returned her greeting with a cold "Hi" and left the room. Among the mourners was Tere Torralba who told me Ms. Cusipag even waived to me while driving out of the parking lot.

Those unexpected incidents had prompted me to write the story which I held on to since February when the Superior Court upheld Ms. Miranda and found Ms. Cusipag liable for defamation.

For her defense, she relied on a newly-minted lawyer, Dominador "Jun" Saludares, a long-time paralegal who was found by the Law Society of Ontario in 2019 to have engaged in professional misconduct, suspended for three months and made to pay $5,000 in costs.

"In this case," the Law Society wrote, "there was significant neglect of duty and an ultimate fraud of $434,764. But Mr. Saludares is a relatively new licensee. He was licensed only in 2013, and this matter took place in early 2015. He was also new to Canada, having come in 2010. He had no discipline history. The whole matter took place over a seven-week period and involved one client only."


That brings us back to Ms. Cusipag's bravado. It seems obvious that she forgot to learn her lessons the two defamation cases she had lost have provided again by, in her own words, "being thrifty and underestimating." 

Not to look down on Mr. Saludares, but he, in my considered opinion, was not a good choice to defend Ms. Cusipag and Balita from Ms. Miranda's defamation suit. For most of the years as a paralegal, he was engaged in real estate.

And that is not to say Ms. Miranda's case against  Ms. Cusipag was not strong. It was strong and well-founded.

I thought this was a repeat of the same situation that had existed in two earlier defamation cases where litigants had enlisted experts in the field while Ms. Cusipag had relied on the simpleminded advice of a friend to hire his friend to represent her.

That was the cause for her saying to hire "not just lawyers" but "good ones instead" to litigate the disputes in the Ontario Superior Court. 

To not have competent and robust representation - as what had happened to her in two cases where this reporter was also a defendant - was devastating personally, professionally and financially.

Mr. Saludares was called to the Ontario Bar sometime in January 2023, after working as a paralegal from August 2014, published documents show.

As a lawyer, his first serious client (in the case filed by Ms. Miranda) appeared to be Ms. Cusipag who, on January 20, 2023, was served a libel notice at her home office in Markham by a process server of the City of Toronto.

Ms. Cusipag is reportedly negotiating lowering and/or not paying damages to Ms. Miranda, the same tactic she had employed in the previous defamation cases. She eventually paid close to half a million each to the plaintiff.

Another day of reckoning has arrived for the boastful publisher of a local Filipino tabloid in the Greater Toronto Area. The self-proclaimed "millionaire" 
has told the Superior Court she's hard up to pay damages to the plaintiff who brought a defamation lawsuit against her last year.

TORONTO - A Superior Court judge has found Balita publisher/editor Teresita "Tess" Cusipag liable for defaming businesswoman Liwayway Miranda aka Lily Hammer, the Filipino Web Magazine has learned.

The verdict, handed down in mid-February, has not been publicly announced by either of the two litigants. This reporter has sat on the story for months, hoping the tabloid would come through with its vow of transparency.

Informed sources said Ms. Cusipag has instructed her lawyer, Dominador "Jun" Saludares, to appeal, arguing that she's broke and unable to pay the damages sought by Ms. Miranda.

The court has set March 2025 to hear and finalize its decision.

Reached for comment, Ms. Cusipag said: "I dont (sic) know what you are talking about but I sent to to (sic) the lawyer and you can communicate with him." (Related video: https://www.youtube.com/watch?v=Y9ykwazA-WE)

This reporter continued to press for an explanation, saying: "If what you say here is true, I can only assume your lawyer withheld valuable information from you. How can you NOT know what I'm talking about in my questions related to the defamation case against you?"

Ms. Cusipag did not respond. Neither her lawyer.

For her part, Ms. Miranda said the judge has asked them to negotiate the amount they're able to pay her, which was the reason for the March 2025 hearing. (Related video: https://www.youtube.com/watch?v=lx7ZOhfQZ70)

"They only offered that they will pay my legal fees, expenses I accrued in this trial, promised to remove all the articles in BALITA about me and promised not to write any defamatory articles about me . . . which 100% I did not agree," Ms. Miranda explained. 

"They refused to pay the general damages and punitive damages," she added. In an earlier filing, Ms. Miranda asked $150,000 for general damages and $100,000 for punitive, exemplary and aggravated damages.

This is the fifth defamation case filed against Ms. Cusipag and her tabloid. In four of the cases (disclosure: this reporter was also a defendant), she lost two. In one, the judge cited her for criminal contempt and sentenced her to 21 days in prison. She got off after serving 13 days.

Years after Crown prosecutors had dropped all charges against Ms. Miranda, and announced by the Ontario Superior Court on December 11, 2019, Ms. Cusipag continued to attack Ms. Miranda in Balita and in her Facebook posts.

In one posting, she said: " . . . another notorious alleged scammer is Liwayway Miranda Hammer who up to this time is still hunted by victims to serve court documents."


She also implicated her lawyer, writing that: "Liwayway was branded as the summa cum laude of scammers in Toronto according to paralegal, soon to be a practicing lawyer Jun Saludares."

Saludares had been a paralegal since January 2014 before being called to the Bar in January 2023. He now practices immigration law and real estate. (Copyright 2024. All Rights Reserved).
